Right of Withdrawal

1 – Right of Withdrawal

In any case, the Buyer has the right to withdraw from the contract stipulated, without any penalty and without specifying the reason, within 14 (fourteen) calendar days from the day of receipt of the purchased goods.

2- Extension of the Withdrawal Period

In the event that the Supplier has not fulfilled the information obligations regarding the methods and times for returning or collecting the goods in the event of exercising the right of withdrawal pursuant to art. 52 of the Consumer Code, the deadline for exercising the right of withdrawal is one year after the end of the initial withdrawal period (14 days).

3 – How to Exercise the Right of Withdrawal

To exercise the right of withdrawal, the Buyer must communicate their decision in writing to the Seller by sending an email to servizioclienti@classe1935.it, specifying the order number and the products for which they intend to exercise the right of withdrawal. It is recommended that you keep a copy of the communication sent.

4 – Return of Products

The Buyer must arrange, using a carrier of their choice and at their own expense, the shipment of the purchased product(s) within 14 days of notifying the right of withdrawal. The products must be packaged in their original packaging, complete with all accessories, and must not have been damaged or altered. Returned goods must be sent to the following address: Classe 1935 – Via dei Muratori 28 A/E – 76121 Barletta (BT).

5 – Refund and Termination of the Contract

Only after receiving the product(s) and verifying compliance with the terms and conditions for exercising the right of withdrawal, as well as the integrity of the products, Classe 1935 will proceed, as quickly as possible and, in any case, within 14 days of the return of the goods, to refund the sums paid by the user, excluding shipping costs incurred for the delivery of the goods. The refund amount will be communicated via email and credited to the payment method or solution used for the purchase. The value date of the refunded amount will be the same as the date of the debit. Upon receipt of the notice of withdrawal, the parties to this contract are released from their mutual obligations, except as provided in the previous paragraphs.

6- Exceptions to the Right of Withdrawal

The Buyer cannot exercise the right of withdrawal for purchase contracts of:

• Goods packaged to a specific or clearly personalized specification, such as products colored or mixed according to the consumer’s requests.
• Products that, by their nature, cannot be returned or are liable to deteriorate rapidly, such as varnishes or paints that may deteriorate once opened or exposed to air.
• Supply of goods whose price is linked to fluctuations in market rates.
• For training courses purchased online, whether in person or remotely, the right of withdrawal cannot be exercised once the service has been fully provided.

7 – Return Costs

The only costs owed by the Buyer for exercising the right of withdrawal are the direct costs of returning the goods to the Seller.
